How will I know when my hearing is - and do I have to go?

You will receive a Notice of Hearing in the post, via email or from hospital staff. This notice tells you when and where your hearing will take place.

Hearings are generally held at your hospital or community mental health service. Your hearing may also be conducted via video conference. If you prefer to attend the hearing from home, please email the Tribunal at registry@mht.wa.gov.au

You do not have to attend your hearing, but it is encouraged if you would like to discuss your views about your treatment with the Tribunal. If you decide not to attend, the hearing may proceed without you.

How to prepare for your hearing:

Read the My Views and Wishes form.

 

At your hearing, the Tribunal must consider your views and wishes.

 

If you are in hospital, you may ask the treating team to send the form to the Tribunal for you, or you can submit it yourself via the MHT Document Lodgement Portal to the Tribunal at least one day before your hearing.

Read the medical report.

Think about what you would like to discuss with the Tribunal.

This may include an Advocate from the Mental Health Advocacy Service and/or a lawyer from the Mental Health Law Centre.

Think about who you want with you at your hearing.

Transcript of a hearing

Access to Tribunal transcripts is very limited. This is because of the strict privacy and confidentiality requirements surrounding Tribunal hearings under the Mental Health Act 2014.

Requests for transcripts made by a patient, or on behalf of the patient by a patient’s representative (legal practitioner, mental health advocate, or nominated person), will be granted only in exceptional circumstances. If you need a transcript of your hearing, please complete a request form in writable pdf or Word and send it to the Tribunal for consideration.
